Does New Mexico Require an SR-22? The MVD Lists Proof of Insurance Instead

Last checked · Sources listed below

The short answer

New Mexico's Motor Vehicle Division lists only proof of liability insurance for every suspension type in its reinstatement procedures and does not mention an SR-22. Under the Mandatory Financial Responsibility Act, that proof can be an insurance policy or certification, an insurance binder, a certificate of deposit from the State Treasurer, or a surety bond, at the state minimums of 25/50/10. If a court, an insurer or another state tells you that you need an SR-22, ask the MVD to confirm what your record requires and bring your suspension notice. If another state ordered you to keep an SR-22, that state's requirement continues after you move to New Mexico.

What the MVD lists after a suspension

RequirementDetail
Proof of liability insurancePolicy or certification, binder, State Treasurer certificate of deposit, or surety bond
Minimum limits$25,000 bodily injury per person, $50,000 per accident, $10,000 property damage (25/50/10)
Bond or cash alternative$60,000 surety bond or deposit
License reinstatement fee$25
Registration reinstatement fee$30 (including MFRA insurance suspensions)
Ignition interlock cases$50 interlock fee where applicable

Why this matters

New Mexico has the second highest uninsured driver rate in the country: 24.1% of drivers in 2023 per the Insurance Research Council. Its state reinstatement fees are $25 for a license and $30 for a registration after a no-insurance suspension ($102 after a DWI revocation). Your insurance premium is set by the insurer.

FAQ

I was told I need an SR-22 in New Mexico. What should I do?

The MVD's published reinstatement requirements list proof of insurance, not SR-22. Ask the MVD about your specific case and bring your suspension notice.

I had an SR-22 requirement in Texas and moved to New Mexico. Does it end?

No. The state that ordered it keeps the requirement. Ask your insurer whether it can file an out-of-state SR-22 on a New Mexico policy.

What are the minimums?

25/50/10.
